Terms of Service

These terms govern your use of the Toonsona website and service (“the Service”), which is operated by Arcana studios, LLC, a Delaware limited liability company (“Toonsona”, “we”, “us”). By creating an account or using the Service you agree to them. If you do not agree, please don’t use the Service.

What Toonsona is

Toonsona lets you design characters, build the sets they film in, and turn scripts into AI-generated talking videos for platforms like TikTok, Reels and Shorts. Generation runs on third-party AI models, so results vary and individual generations can occasionally fail — see “Credits” below for how failures are handled.

Your account

You must be at least 13 years old (or older where your local law requires) to use the Service, and old enough to form a binding contract, or have a parent or guardian’s permission. You are responsible for your account and for keeping your sign-in credentials secure.

Subscriptions and payments

• Paid features are unlocked with credits, which you get through a subscription plan or one-time credit packs. Current prices, plan contents and the credit cost of each action are shown on the in-app credits page and at checkout.
• Subscriptions renew automatically at the end of each billing cycle until you cancel. You can cancel any time from the billing portal in your settings; cancellation takes effect at the end of the current paid period and you keep access until then.
• Payments are processed by Stripe. We never see or store your full card details. Prices may exclude taxes, which are added at checkout where applicable.
• We may change prices or plan contents. Changes apply from your next billing cycle, and we will notify you before a renewal price increase takes effect.

Credits

• Plan credits are granted each billing cycle, are spent first, and expire at the end of the cycle — unused plan credits do not roll over. When a subscription ends, remaining plan credits from it are forfeited.
• Pack credits (one-time purchases) do not expire while your account remains open, and survive a subscription cancellation.
• Credits are deducted when you start a paid action. If a generation fully fails, its credits are automatically refunded to your balance.
• Credits have no cash value, are not transferable, and can’t be exchanged for money. We may adjust balances to correct errors or address abuse of the credit system.

Refunds

Because credits give immediate access to digital content generation, purchases are generally non-refundable once credits have been granted, except where the law of your country gives you a right we can’t exclude. If something went wrong with a purchase — a double charge, a purchase you didn’t make, credits that never arrived — contact us at hello@toonsona.com or through in-app support and we’ll make it right.

Your content

• You keep ownership of the scripts, reference material and audio you upload, and of the characters, sets and videos you create with the Service.
• You give us the license we need to operate the Service: to host, process and display your content in order to generate your videos and run your account. Generating content requires sending your inputs to the third-party AI providers that run the models.
• You must have the rights to what you upload. In particular, only upload reference photos of yourself or of people who have given you permission — see the AI & Content Policy.
• You are responsible for the content you create and publish with Toonsona, including where you post it and how you present it.

AI-generated content

• Videos, voices and characters produced by the Service are synthetic media. Outputs may be inaccurate, incomplete or unsuitable for your purpose — review everything before you publish it. Generation requests may also be declined by the safety systems of our AI providers.
• You must follow our AI & Content Policy, which is part of these terms. In short: no impersonating real people without consent, no deception about what is real, and no illegal or harmful content.
• Many platforms (including TikTok, YouTube and Meta) require you to label AI-generated or synthetic content. Complying with those rules when you publish Toonsona videos is your responsibility.
• We may embed provenance signals (such as watermarks or metadata) in generated videos, and you may not remove them.

Prohibited conduct

You may not misuse the Service — including breaking the law, violating the AI & Content Policy, infringing others’ intellectual-property or privacy rights, attempting to break, overload or circumvent our systems or usage limits, or reselling the Service without our permission.

Intellectual property

The Service itself — including the Toonsona name, design, software and built-in assets — belongs to us or our licensors. These terms give you no rights to it beyond using the Service as intended. If you believe content on the Service infringes your copyright, email hello@toonsona.com and we will review and, where appropriate, remove it.

Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee that generated content will be error-free, that the Service will be uninterrupted, or any particular results (views, followers or revenue) from content you publish.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service or the content you create with it. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these terms excludes liability that cannot be excluded by law.

Indemnity

If someone brings a claim against us because of content you created or published with the Service, or because you broke these terms, you agree to cover the costs and damages that result.

Termination

You can stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you break these terms or the AI & Content Policy, or if we discontinue the Service. If we terminate your account without cause, we will refund the unused portion of any purchased credits; if your account is terminated for breaking these terms, remaining credits are forfeited.

Governing law

These terms are governed by the laws of the State of Delaware, United States, and disputes will be resolved in the state or federal courts located in Delaware, without affecting any mandatory consumer protections you have where you live.

Changes

We may update these terms as the product evolves. We will post changes here and update the date above; significant changes will be announced to users by email. Continuing to use the Service after a change takes effect means you accept the new terms.
